They're not stupid. These games sell, they'll make sure to yank all the milk out of them, even to the point of their own risk.
Isn't Cubic Ninja the last game they want people knowing about? Looking for a copy, even with no knowledge of hax, is bound to lead to a CFW life due to its rarity

CN doesn't appear in the EU eShop at all. I don't think it was ever listed in there in the first place anyways. It's listed in the Japanese eShop though with a message saying that you can no longer buy it digitally.
U eShop version can't be used with Ninjhax. It was either physical cartridge or J eShop version. Smea said this when he released Ninjhax 1 I mean, it's free money from kids who wanna hack but don't check if its compatible
You can't BUY it from the eShop tho. Look under the name And its only physical cart/J eShop b/c those are the only places it was released for purchase
Why advertise it AT ALL? People may want the game, and find that they can't buy it from the eShop, so they may look for a copy, discover Ninjhax, and become one of the hackers the more the merrier
