CN doesn't appear in the EU eShop at all. I don't think it was ever listed in there in the first place anyways. It's listed in the Japanese eShop though with a message saying that you can no longer buy it digitally.

U eShop version can't be used with Ninjhax. It was either physical cartridge or J eShop version. Smea said this when he released Ninjhax 1

Why advertise it AT ALL?
People may want the game, and find that they can't buy it from the eShop, so they may look for a copy, discover Ninjhax, and become one of the hackers

the more the merrier
