I've been reading the posts of people who are absolutely certain they didn't go online ingame, yet they're still banned. Could that be related to the "show friends whay you're playing?" option in the Friend List settings? I have it disabled just because I like it that way... Needless to say I didn't get a ban.

The console does get some online activity in the background... Also, both eShop and Spotpass have options to send certain system information to Nintendo... Things I disabled too. Interesting.

No bypass thing or anything. I literally just relinquished my NNID to Ninty and played stupid like a bought an already banned console and they unbanned it for me after about 30 minutes of circle jerking me.

EDIT: If I had a bypass method I would have shared it. I just took the chance that Nintendo wouldn't just say "SOL" and they didn't so. Try is all I can say INB4 "Everyone suddenly bought a banned DS"

I was going to do this, but wanted to wait for the games to come out. Wanted to have a serial ID for the game cart and a better excuse to "buy" a pre-owned 3DS.

I never had a normal sized 3DS, old or new. Are they big enough? I have big hands, it's why I prefer the XL. I don't think I'll make the money to get an N3DS XL by Black Friday, so I'll probably fork over for the sweet deal.
