Hacking guarranty and ds lite

I have a question, i bought ds lite on internet auction, but his volume slider is in bad shape (because button jumps a bit (like 0,5 mm up and down, and when im sliding this slider sometimes its doesnt move smooth) i have quarranty on that ds , can i go to guarranty to service to repair that, or they wont do that ? (volume slider can function, but it is losen too much and is estetic discomfort when i use it).

Mine does that but it doesn't affect the switch working at all, doesn't really bother me now. But I can see how it could. I've never heard of someone claiming warranty for that before though, is it really worth the repair time?
