Homebrew Going into street pass mini plaza gets rid of custom themes

When I go into this and out my themes are all gone

Are the themes installed as CIA or through CHMM?

Yes

Use CHMM2 then. CIA themes will get deleted if you use the eShop, Nintendo Zone Viewer, or StreetPass Mii Plaza, if you did.
