I'd imagine that the average 3DS user (you know the ones, daddy bought it for the kids or 3DS shared by the entire family bought by non-informed user that just heard of it on TV) does exactly that...
"Oh, it prompts me for an update, better do that!"
Some others may never even touch the online functionality and the device will never be updated at all.
The device doomed to play the same 3 games untill it falls apart or gets left to gather dust.
My experience is that the majority of users out there are not particularly tech-savvy. To the point where its a miracle that some of them can turn the devices on at all.
Hell, just scroll back through the pages and read how often the "does it work on 9.x - U/E/J" question has been repeated.
People even if nintendo pushes out 9.3 chances are it won't matter..yes when nintendo released 5.0 they patched the kernel exploit gateway was using before gateway was even released but if I'm not mistaken that kernel exploit wasn't found by gateway and was documented on 3dbrew so thats how nintendo knew about it *i can be wrong tho*.
The exploit they're supposedly releasing this time would be an UNKNOWN kernel exploit (if thats what it is) they can release firmware 11.5 and it wouldn't matter since the exploit would still be there unless of course nintendo gets lucky and patches that same exploit (which would already be done if they knew about it).
I think people need to stop speculating and focus on the fact that there is a solution for users who updated past 4.x.
If it's a Sky3DS clone, how are 9.0/9.2 users going to update the cart? Since an update is required for the flashcart to function on the latest firmware and Sky3DS being a 1:1 cart, I am assuming it's not possible to update the cart. Gateway must have found an exploit. Whether it'll have more or less features, that will be answered in time. As for the reason Gateway asked users to stay on the old firmware, why in the world would they ask them to update if the update was not even released to begin with.

Fpga is the internal cpu, but it would need programmed before it knows to look for that kind of updateYeah, DSTwo can do it because it has an internal CPU. I don't think this is the case for Gateway.
(unless they made a little one hidden in the FPGA all along and I'm not sure this is possible in this case)

People on 9x shouldn't be buying Gateways yet... For what we know, you'll need a 4.x 3DS in order to update the card or else it won't even work. Retailers will update them for us when the update is released.
he doesnt need a source he said "for what we know"....i.e we don't know either way, so its silly to jump the gunsource?
