I doubt that they will release n3ds support anytime soon - so well go on update your DS and access eShop for your digital needs that train is over! nothing to see.

You could always mute it I would not advise people to update just yet.. Gateway only supports up to firmware 9.2 and updating further will prevent you from using Gateway if/when they start supporting the N3DS. It is my understanding that you don't necessarily need to update to the newest firmware if you want to use sky3ds... only if you want to use eShop (Can someone confirm?). Personally I rather wait and see what happens because I prefer using EmuNAND.. seems safer as well.

There's still CFW to be had, we just (I think) got ARM11 kernel via ninjhax, so there's a chance we'll get some more progress.
