That may be but if it was released before publicly we would have support up to 9.2 now wouldnt we?

Ninjhax (or derivate from inverse engineering) could be the gate to the new kernel exploit. Without it, you couldn't trigger the new exploit.

You never know, but its better for GW to keep it quiet if such thing is true and release the follow up exploit later when the N3DS becomes a standard.

Could you technically, make Ninjhax work if you'd put a Cubic Ninja Rom on the GW and install smealums exploit with that?

Oh well as I recall it depends on its Savegame right? Would Roms with GW still save their savegame on the internal SD card of the 3DS or the one in the GW card?

almost certainly, ninjhax works in emunand on 4.x consoles, unless gateway specifically block it from working, i dont see why it wouldnt

i doubt it, afaik you would need arm9 kernel access to load up zero keyed roms like dev menu and homebrew stuff, but im no expert in the matter, so thats just an assumption based on what i have read
