That's true Thomas, but there's also the possibility Sky3DS can be blocked in future firmware updates also Gateway has a multirom interface which makes accessing games faster, and multi region.

remember the release video, people saw the games available to load? well, I think a lot of us noticed cubic ninja there. Of all games they could have had, Cubic Ninja was sitting there. Now I was looking at their ssb4 release video, and there it was! Gateway was also blocked simultaneously with NINJHAX, so I think everyone was correct in assuming sspwn was a similar exploit, and also, smea may have been limiting use so that we can't simply softmod to pirate games!

Smea had the exploit almost prep`d at that point, and confirmed Cubic Ninja was the exploit before then.

that's my idea. Could be off, but it can't be a coincidence that they were patched at the same time.

Maybe if someone smart looked into the cubic ninja exploit, he'd figure it out.
