was it you who wanted to know what FW the console came on from 365games?.....if so it was 9.0 (as expected )

does gateway enable region free for retail carts?
i'm not interested in playing roms but i own 30ish american games i want to play on a japanese new 3ds.
also but less importantly once installed do cia files require the gateway in the system?, cause i pretty much always keep pokemon in my 3ds.

yes. region free comes with GW, and GW has to be in the system to play. Just move your pokemon save to a .cia pokemon sav
