how? :\ i think that the program the system call to take screenshot have nothing to do with sd card, only saving image in it. theme have data saved, so is much more plausible imo (but i can be pretty wrong eh )

Well it 'kinda does, no? When you take a screenshot the system must write an image to the SD card. It'll have to be stored, so there.

Yes, Gateway has given confirmation that the exploit doesn't work on 8.X or lower so it's safe to assume something that was introduced in 9.0 is being exploited. Themes or screenshots? Perhaps an exploit similar to the TIFF exploit that was employed on the PSP?

Thinking back to the 4.X exploit we all know and love, it relied on an entrypoint in the DS settings and went on to exploit something in the kernel or whatever.

I don't think it would be much of a stretch to think that these holes may have existed in the 3.X, 2.X or maybe even the 1.X firmware series, unless there is evidence to the contrary on 3Dbrew etc.

Maybe it really does just come down to convenience for the Gateway Gods.

... or maybe the hole really is only present on 9.X. Who knows? (Answer: Only Gateway does)

I have a feeling that the themes are key too. because they aren't able to be locally uploaded into the devices. and even certain themes are unlocked/bought from the eshop. this potentially might be a gateway into a kernal 'sploit

There's no logical reason gateway wouldn't support emunand on 9.x.

It's not about not wanting to do, it's about NOT BEING ABLE to do (or not being able to do right now).
So far gateway hadn't confirmed emunand, so by now consider that there won't be emunand support on 9.X.

my original order for PAL n3ds is still with 365games (being picked) i have no idea how long being picked is going to be there as it's been on there for 36 hours so far even though i have paid extra for faster shipping. the jap 3ds i just bought was from ebay & i already sent the seller a request to update the firmware for me but he hasn't replied yet !! so i may have to update it myself.
