Heck, you can restore the original firmware without anybody knowing.
But I've done it on my DS Phat and it's still under an EB warranty because it's still in the same condition it was when i bought it.
"against the wishes of Nintendo" has no grounding in law for most places in the world: your device, your choice. The EULA such as it exists for hardware often has to be presented at point of sale (I am fairly sure Australia has it this way) and I am confident you did not have to do anything other than hand over the cash.
You also have the difference between warranty by law and warranty (read insurance) given by the manufacturer; when MS "extended" the warranty on the 360 it technically did little as it was defect courtesy of them (not sure whether it counts as design or manufacturing) which depending on where you are is about 3 years anyway (some are far shorter though so I am not inclined to back that statement as much as I could).
Also I have to ask why the bump?
