It still works!. tested on new 3ds xl 9.0 sysnand.

You mean cracked. It would have to be cracked already for it to be patched.

Assuming you're talking about 9.3 and up since the kernel hasn't been cracked yet.

It doesn't need to be cracked. If Nintendo is able to find out a flaw, they would just work pro-actively and patch it even if it was never public
