i think the basic pack brand new no games came with 4.0.1 i think for me maybe lower

It really depends on when it was manufactured. Although I think they stopped production of the Basic Pack a while ago, so there will be a very, very likely chance of finding a lower firmware Wii U.

I bought a new, never used basic Wii U and it came with 1.0.1 U
Bought it from a seller on ebay less than a month ago. Just make sure it's never been used and you should be on a safe FW
