Is there anyway to play 360 back ups with or without a mod and not get banned? Also will we get banned if we pirate a xbla game? And how would they know anyway? And is there a way to get around the $50 live fee?

No way around the Live costs ... but I have played copied games, on a modded 360, since the 360 was first cracked ...
Never been caught, never been banned ... right now, all you need is the latest ixtreme and stealthed backups ...
EDIT : You cannot pirate Xbox Live Arcade Games, by the way ... with the exception of the ones that got released on a disc, some time ago ...

One thing that just occurred to me.... The sound on the 2600 sucked less back then the harsh sound we hear now is from infinitely better speakers we have now, back when the 2600 was new speakers produced a almost muffled sound, like CRTs made old graphics look slightly better. -

I think a few of the early systems could benefit from that, at least up to the 8 bit generation, by the 16 bit generation I think TVs had gotten a lot better in almost every way

Just give it a try, but honestly if you have a 3DS you can play DS games without a card just off the internal SD card
