GSPwn is a hardware exploit in the GPU of the 3DS that allows us the ability to even use the homebrew loader. Why do you guys think that Nintendo didn't solve the hardware exploit with the release of the New 3DS?
The N3DS was already released in Japan a month before ninjhax was released.
tldr: it was already finished hardware
And even then, the N3DS has to be compatible with the 3DS, so they're kinda stuck with the flawed hardware anyway.
