Dbrand no longer selling PS5 faceplates after Sony threatens legal action

Selling faceplates for the PlayStation 5 seems to be a lost cause. Last year, a storefront called PlateStation, which was selling customized faceplates for the PS5, was forced to stop after threat of legal action from Sony. A few months later, Dbrand, known for their tech decals decided to get in on the market, by offering their own black faceplates called "darkplates" for the console, even going so far as to joke about the matter by advertising them and saying, "go ahead, sue us" to Sony. The latter took it seriously, as they've done just that. A cease and desist order was issued by Sony to Dbrand, which resulted in the latter being forced to remove their PS5 faceplates from sale; if you now attempt to visit the store page link for them, it redirects you to a list of news reports specifically about Dbrand taking the darkplates off the market.

Quotes from the letter were posted by Dbrand's marketing team to the brand's subreddit, with a breakdown of the incident from their point of view. Sony alleges that the shapes used on the darkplates infringe upon their trademarked PlayStation face button symbols. Dbrand clearly uses a cheeky spin on the PlayStation look by using the same square, circle, triangle, cross look: a cross-shaped skull and bones, a circular radioactive symbol, a square robot head, and a triangle with a rune in the center. That isn't the only issue with the darkplates, though, as further on in the letter, Sony's legal team mentions that "the two vertical faceplates has become exclusively associated with [Sony] in the minds of consumers, and has come to symbolize considerable goodwill", meaning they find the sale of third-party faceplates to be an issue regardless.

Quote from Dbrand:
While we strongly believe in the consumer's right to customize and modify their hardware with aftermarket components, your Darkplates are now a collector's item. You know what they say - you either die a Darkplates owner, or you live long enough to see yourself become the scalper.

Imagine being Dbrand... The company who just does not give a shit and will troll anyone and everyone.. To aggro Sony like that, and then roll over at the first sign of trouble. How valid would a lawsuit be over plastic? Or were they selling faceplates with copyrighted works? No? Okay.. So, Sony is just the big bad playground bully.

Did they have the PS logo on the top like the PS5 has ? If they are using the PS logo, they can force them to stop, that would be copyrighted logo and they can sue.

If they are just flat with no holes (or a 3rd party logo in place of the PS logo), then let Sony try to sue... They would not have a ground to stand on. Don't go through them, go on eBay, they have some for $35, never mind on all the Chinese sites..

It's like you buying a brand new car, and you get rid of the factory rims, and put a 3rd party on... Would Toyota sue you because of that ? Don't think so.

I would think Sony would like this, people love their console so much they want to customize it...

remenber small compnays dont have the money to pay for lawyers and process costs that could drag on for years before a decision is met, that is how big company's win most of the time, they know they cant win but they drag the processs for as long as possible, until the tiny company just goes bankrupt or stops paying for the legal fees and they technically win by default.

most small time compnays know this, they dont have the money to even win if they are right.

if Sony had an "image of goodwill" they wouldn't have cared about a third party place selling PS5 panels, its literally a hunk of plastic that makes the system look good and not vital to its function so its not like it had to be reverse engineered or anything.

If they didn't put specific logos on it, then yeah, I don't see why Dbrand backed down.

If you've made it this far down the page without buying anything, you're probably a lawyer. Good news for us, bad news for you: there (probably) aren't any newly-approved patents on custom LED lightstrips, middle skins, or all-new Darkplates 2.0 colorways. Serve us another C&D if we're wrong.

am i the only one worried that the new designs are worse? sure the console will get coller but the ammount of dust that has a direct acess to the ps5 he console is not running seems it will be worse in the end imo, that vent is too big, lots of dust and other small crap will just straight up enter when the console is not running and build in there.
