    I don't think that the point in this case is necessarily what announcement they made, rather the point is that they have made an announcement in the first place. Were they to abandon the project it would have been better for them to stay quiet into the void of time and disappear from the scene. Until I read this forum post I was skeptical too, but I do not see why they would make such noise after being quiet for so long if what they said hadn't been true.

    Not saying it's going to happen, but it seems more than likely. Or they could be playing some 9D logic-breaking chess.

    My experience in real life is that a lot of Atmosphere users don't know what Sxos is or that it has features others os don't.

    why sxos user will not know about atmo ? whats your base here ? for an example if one puts cfw nintendo switch on google you have more atmosphere than anything so...

    It's pretty difficult to not know what either SX OS or Atmosphere is, regardless of which one you use. And for the foreseeable future, there's going to be constant back & forth arguing over which one is better, because apparently the concept that different people have different wants & needs out of their hacked Switch is a difficult concept for some to grasp. It's like the Mac vs. PC debate, or the iOS vs. Android debate. Nobody should actually care, and yet for some reason they still do.

    Keys aren't copyrightable, but they could be covered by the DMCA. In fact it's the major reason that the DMCA is even required, if keys could be copyrighted then everyone would just copyright the keys and instantly everything the DMCA prevents is already covered.

    If SciresM says they are copyrightable then he's lying or unwilling to read the copious amount of evidence.
    If SciresM says that they are covered by the DMCA then so is atmosphere and therefore he's knowingly breaking the law by distributing it.

    Well I actually don't know if it's illegal, I think a judge would have to decide. At the same time he would be deciding if atmosphere is illegal. It sails very close to the DMCA wind.

    SciresM however says atmosphere isn't a DMCA violation, so he has no basis for stating the keys are.

    No, I was talking about burning an exploit to just get past TSEC. The two things are completely and utterly separate.

    But the polling data is flawed, you're extrapolating heavily. You are obviously biased towards a specific outcome and are cherry picking things that could be true to build it up. You have no standards whatsoever.

    I suggest you adopt some standards.

    Or the post only exists because of the trolling and irrational fear that 7.x will never come, see how your bias is coming through in your posts and how you can write the same thing in an opposite biased way that gives a completely different spin?

    Once you strip out the bias then you're actually just stating the obvious as they already said they only posted because of the speculation.

    If you didn't post with such bias all the time then nobody would need to correct you. I also don't understand why you seem intent on stating the obvious, of course they could just be lying. Does anyone actually need to state that? They are human after all.

    They probably didn't even start work on the actual exploit for obtaining keys until they realised they couldn't steal it from Atmosphere. It's a shame really, I wouldn't be surprised if they're working on reversing Sept rather than figuring out their own way for the keys.

    You know, considering how pretty much *every* update has been made *after* an open-source implementation of something had been released, people have the right to think they're taking longer to try and bypass sept so they can once again claim it as their own work.

    I'd like to point out that I have seen no evidence of that and also lawyers can be ignorant of the law, otherwise there would be no disagreements between lawyers in court.

    However if SciresM says keys can be copyrighted, then you really really don't want to hire him. It's pretty simple stuff in copyright law with plenty of precedents.

    Do you have a link? I tried googling Michael Scires lawyer and nothing comes up. There is a "Michael Scire" but there are 11 of those on linked in. Maybe it's this one?

    I highly doubt he said such a thing so those folks are probably misinformed or using terms interchangeably (which is the more likely). There can be copyright on IMPLEMENTATION, but not algorithms proper. However, there is the concept of an "illegal number", such as the AACS key, distribution of which was a violation of Title 1. This would almost assuredly be the case here.

    I don't remember if he's specifically a lawyer, but he does do something along those line, it has been discussed many times on ReSwitched

    He never said they are copyrighted, he only ever said they're illegal to share, and I trust sciresM, a person who has done alot for both the 3ds and Switch scenes than some random Gateway shill on gbatemp...

    You're ignoring the fact that this not only affects Atmosphere but literally everyone. So the dude who got assaulted is at fault instead of the assaulter?

    Yeah, he's being deliberately vague because he has no real basis and doesn't want anyone to be able to easily prove him wrong.

    There are only two ways they can be illegal to share, one is if they are copyrighted and the other is if they are involved in anti circumvention.

    If they are involved in anti circumvention then so is atmosphere, specifically when the sept payload derives the keys to decrypt the next stage of the OS.

    If you are willing to remain willfully ignorant of the issue when it's so easily verifiable by five minutes reading online, then there is no hope for you.

    I am not a shill, I have a strong background in DMCA related activities. I have no interest in TX, I don't own it and have never communicated with anyone from TX.

    Well you had a choice and you chose the one that ended up with you being killed, your family will always wish you had just given them the wallet. Is that the same as fault?

    Maybe they have a criminal record, mental health difficulties, is on drugs and it's impossible for them to get a job. But you can judge him from the safety of your own home if you give him your wallet and avoid being stabbed.
