Hacking .cia Online play (N3DS GW3D 9.2)

I've heard that you don't need a private header on .cia games and that you can play online without the fear of getting banned, just like if you would have had a private header on a .3dz rom? Is it true? Could i just go on .cia version of smash (or whatever) with the latest game update and play online?
