As of today 5pm PST, 11.8.0 is required to play online.

I was playing online a Monster Hunter Generations rom for 75hours on the last firmware, without any ban problem.
Do you know if I can keep playing at it online with the 11.8.0-41E update ?
I just did the update cause it was necessary to keep playing it online.
But I've read the new update implements the same anti-piracy system than the switch have, and an autoban system is now on.
Is that true ?

I'm pretty sure the autobans only apply to illegitimate eShop downloads (stuff like FreeShop)

Then again wouldn't you have had to have registered your ds with the network to be banned in the first place?
I haven't and won't with my luma 3ds.
I have my non cfw 3ds for that.

Well I haven't been banned yet, that's why I'm asking the question.
I don't have the chance either budget to get a second 3ds.
But I have some money to buy myself a Mhgen official cartidge. Game wich I love and I'm ready to spend some money in it.
So my next question : I've luma installed, would I be able to play on my Mhgen cartidge without getting ban ?

By having CFW alone you're risking yourself to a ban and also you have the best security against it.
Update and play. I have done it since the 11.8.0 appeared (like a f*kcing wild Pokémon, ruining the glorious freeShop and all CDN downloading homebrews)… but, ammm… yeah, update it. There're any abnormal risk, just the usual.

You are not avoiding anything by not updating. You're still prone to be banned if a ban-wave happens, or if you cheat online. There hasn't been any bans because updating to 11.8.0 or by playin' online after updating.
11.8.0 is safe, just check if you're running the latest Luma3DS and you're good to go.
