Can nintendo detect if you have pirated games and ban you on 11.6?

    I believe it's only on 11.8... Though, if you want to be on the safe side, download the games on cia, and install the games with FBI or devmenu.

    You are all good on 11.6 and the new detector in 11.8 aplies only while downloading a game not while playing it

    Probably home.
    It's not a thing on either firmware, what they can do now in all versions (becuse it's a server side change) is detect if a ticket is forged or not when you attempt to download using it.

    There's no difference between 11.8 and other versions when it comes to that.

    no... Even on 11.8 they really can't detect it.

    They can't detect if you just have pirated games installed, but avoid using freeShop or similar, since the new server-side changes could be used to detect pirating attempts if you try downloading games/DLCs

    to answer they can't detect a pirated cia that is installed. what they can detect is you using freeshop to get games you dont have the right to, and block the download and potentially ban your console also if you are using like a sky without a proper header they can detect that as well but i digress

    playing cia games is safe . . . stealing nintendo licensed games directly from nintendo is not
