Well, I've searched for this, but I didn't find an answer...
Can Nintendo know if the music on my 3DS is pirated? If so, can they brick my 3DS because of it?
Sorry if that's a noob question, but I don't know...

No, but Shigeru Miyamoto will jump out of a green pipe that miraculously appears in your living room and jump-kick you in the face before setting everyone you know and love on fire with a Fireflower, sparing you, and in typical Miyamoto fashion, he will draw you a picture of your horrified expression so you may cherish the moment forever just before jumping down the green pipe once again.

True story. It happened to my brother's friend's uncle's sister's niece.

The most they can do is ban you from online stuff, but you just have music on there. I don't think they care much about that.

no... they will not suspend your online features as this will prevent you from handing them more money...so hope this is the last of this rumor. i Guarantee that they will not brick any 3ds system intentionally for any reason in the june 6th update. and if they do feel free to send me your bricks.

What I want to know is if they can discover that the music I'm using is not original...

no... the only way to prove that the music is not original is to come to your house and take your hard drive and search for the downloads you have done also if you dont have the hardcopy then its curtains for you but this will only happen if you download a flagged file and it is reported to your internet service provider where upon they will send you a letter asking you nicely to stop being a pirate and to not continue such downloads.. if you were to continue your isp would have the authority to give said information to the actual authorities

Nintendo can do whatever they want, updates have been known to brick devices unintentionally. As far as intentional disabling of devices I know that Microsoft used to do all sorts of nasty things such as corruption to your 360 if it detected a modification , but they never went as far as bricking it. Unless Nintendo starts restricting music content to drm content only they could care less what your listening to though.

1. Nintendo cannot brick your system as it is illegal.
2. Nintendo has no way of telling if it is pirated or not.
3. The most they can do is ban you from online as that is a service, not an object.

They can brick your 3ds, but they will not do that because they are not interrested in preventing music from being pirated and anyway I don't think they know if you pirate music lol.

It's the least of your worries.

Nintendo could care less even if you watch pirated porn on it. They have bigger problems than someone listening to pirated music on their handheld gaming system.

Of COURSE they can tell. They're ALWAYS watching you. Next time you're in the shower, just remember that Satoru Iwata is outside the window, and when you're in bed at night, you can sleep easy knowing that Shigeru Miyamoto is hiding in your closet.
