ROM Hack Can i download dsi shop games without updating?

I would like to download some dsiware games:

-Opera
-Warioware:snapped

but i wouldnt like to upgrade.

i tried to put some roms to my SD card but my ds wrote that " this game cannot be copied" or something like this.

Is there a way to install Opera/warioware to my DS without upgrading ?
