maybe its dirt?

You could disasssemble it (just remove the back) then remove the L and R buttons (watch out for the little coils.. try not to lose them) then you can dip the little swtiches in rubbing alcohol or something similar.
Or just buy new ones and replace them.

on the dsi you would just blow under the bumper really hard and it worked again like new, not sure if u can do that with the 3ds bumpers. see if there is a gap under it and blow really hard.

i had the same thing with my 3ds a few days ago. i didnt have the proper screwdrivers to open it up so i just took a never used toothbrush and brushed as best as i could in the space between the button and the case. fixed my buttons right up.
