Apple versus Samsung part 2 - A trial won, a trial lost for Apple

    As many of you know, Apple has been attacking Samsung both inside and outside of court. The first trial ended with an infamous $1 billion verdict against Samsung. That was a bit of a letdown for Samsung, but Apple continued with a victory in its pocked and the second part saw Apple demanding about $40 per phone. How much is that $40 exactly? Over 2 billion dollars! Samsung on the other hand was asking for a mere $6 million for its patents.

    The part 2 of the trial has now seen its end with both parties seeing wins and losses. Both parties were ordered to pay damages to each other, though Apple has the edge here with $119.6 million compared to Samsung's $158.4K. As you can see, Apple won the court trial and was given quite a few million. Still, the trial is a win for Samsung too, since it didn't have to pay $40 for a few patents Apple claimed were essential for Samsung's Android UI.

    Thoughts? It's interesting to see how the trial will change the dynamics of the two companies. Here's one hoping for more mobile patents made into standard essential. Another option would be to modify the possibilities of software patents.

    Well, taking into account that Apple has been harassing pretty much every Tablet / Smartphone driven company, trying to take down everything and everyone, including the famous "Rounded Corner Patent", I'd say that the company is a perfect example of Technology Dictatorship.

    I have an iPhone myself, only due to work related necessities, however I've come to see much of the truth behind the awesome "Apple" brand.

    They behave like in the middle ages. We invented the first rectangular touch screen device, therefore, no one else can make them.

    samsungs profits - court costs = profit and no more court , so in a strange way i see samsung as winning . Or maybe im hungover.

    Do I even dare to ask who the fuck is winning in this fight?

    Yeah, apple gets payed nearly 1000 times as much as samsung, but that they have to pay as well is an important symbolic fee. Not to mention the fact that they get far less than they originally asked. Or that the entire patent system is perceived more as a money grab than as something that protects inventors. In other words: it is questionable if this sum makes up for the damages in apple's reputation. :unsure:

    The question is, how does Apple perceive this matter in connection with their reputation?
    Apple"tards" I know still buy iPhones like hotcakes and I don't even think they know about this dispute between Apple and Samsung in court.

    Fanboys will always be fanboys. Just look at the wiiu part of this forum. ;)

    No...the key to this thing is growth. Convince the non-apple users to buy them. That'll be harder with this outcome. People who previously knew apple as an innovative company will probably think that died with Steve Jobs (even though those legal battles were something he too started) and will be more open to other companies (in other words: android).

    In my opinion this was a huge win for Samsung. The trial resulted in pennies for Apple instead of a possible stable revenue from also the competitors' phones. Since the patents in question are standard features on any modern mobile OS, but are still not standard essential patents, the gains would have been huge. To those who don't know what standard essential patents are: patents that are required to make a mobile phone. Many are owned by networking companies such as Motorola (Google), Nokia and Ericsson. The companies are required to cross-license the patents at a fair price, usually in bulk for a set amount.

    Apple's reputation won't take that much of a hit, but I presume the stock prices will plummet. iOS is not gaining much market share in the growing markets regardless of the sales growing. This is more troubling for the fact that Apple won't be receiving much from the competitors' success as this trial has shown. Interesting to see the future actions of both companies.

    Google sold motorola a few months back. And Nokia has now been purchased by microsoft.

    Neither sold the patents owned by the companies. They just licensed them to the purchaser.
