I'm upgrading myself to an iPod touch 4G from my 1G...

Is there anyway to save my game saves and profiles and get them on my new iPod (for example, I want my Resident Evil save on my new iPod)

I was thinking AppBackup, but I can't jailbreak my new iPod (untethered at least) so that might not work...

A normal backup in iTunes. When you plug your new iPod in, chose "restore from backup of -your iPod's name here-". All your saves, contacts, settings, etc. should transfer.

But it will restore from 3.1.3? I want to start at 4.2.1?

Backups only save files (like home screen layout, contacts, game saves), not the actual apps or the firmware. Your iPod will probably come with 4.2.1 preinstalled, and your backup should be compatible with it. Also, you can't start from 3.1.3 even if you wanted too. Unless you saved your SHSH blobs, you can't downgrade.
