So it has been confirmed that unlinked accounts previously used on a hacked console will be banned after the fact when the console is banned?
It depends on Nintendo. From what I have gathered thus far, account bans are very rare and are usually applied for greater offences. Not to mention that an account ban means you lose access to all your purchases so it might not be legal, in certain places. There is no guarantee that it will or won't be banned if the console is banned but you also cannot unlink the account from the console if it is banned without calling Nintendo. My theory is that if they do allow you to un-link, I see no reason for them to ban you as an unbanned account and a banned console are about as good as an unbanned account. They probably expect you to buy a new Switch after your account is unlinked.

Updated my games yesterday with the method described here by others and works fine. No sd card inserted and no Nintendo ID linked. This all works with the current firmware, but who knows if Nintendo fixes this ‘loop hole’ in the next one. So my advice is if you really want to update the games, is to do it sooner then later.

the proper way to update without talking to ninty is with another console. The switch has a cool feature that lets you check local users for game updates. I haven't done it myself, so I can't comment if it works with games that are not online, but I do know the option is there.

To add onto this, its theorized that using TX's AutoRCM (not briccmii) is what may be whats banning those users over others. There was another theory that those with the dongle and AutoRCM appear to be safer than those without.
Using TX's AutoRCM and haven't had a ban...

Where is this theory stemming from?

Thanks very much for the explanation. After buying the DLC for BotW I really don't need or want anything else from the eShop now but can't rule out getting another clean Switch in the future (have to wait till the new Pokemon game comes out to see what I want todo) so I'd rather unlink now rather than have to call Nintendo and have them do it.

Its not a loophole. Certain games need updates in order to play properly. Its a necessary service that Nintendo must abide to. If for example, you update a game but delete the update data (either by accident or otherwise), the game will not let you play until the update is recovered.

For whatever reason, people disbelieve the few users who have been banned for using SX OS without touching LayeredFS (there's like 6 or 7 by my counts). In an effort to establish a common thread outside of using SX OS, some of them appears to have used AutoRCM. And not the one made by rajkosto known as briccmii but the one developed by TX. Again, this is just a theory as they all also used SX OS. Yet there are plenty of people who have used SX OS as well as the AutoRCM developed by TX so we either are missing something or Nintendo is banning at random.

I don't know. I am fully expecting a ban just for using homebrew and crashing in homebrew.

There have been people banned for that too, however their numbers appear to be lesser than those who used simply SX OS. The ban reports only encompass a fraction of 1% of the entire Switch userbase so of course extrapolation is exceedingly difficult, but early estimates are documenting certain trends.

Theres still not enough data to better define what may get us banned. So, it's safe to assume we're all screwed in the long term.

I've already come to terms with the fact I will get banned, seems like only a matter of time. I've already got what I need and want, so just get it over with and ban me.

This is the method I use to update games and I haven’t had any issues.

1) Select the game(s) you want to update from the sx os menu so it puts it on the main screen.

2) Turn off the switch then remove the sd card.

3) Boot into ofw.

4) Select the game you want to update and press + to update. Note: Update data will be installed on internal memory because the sd card is removed, thus saving precious sd card space. :)

5) Turn off the switch and insert the sd card.

6) Boot into cfw and select the game from the sx os menu and load it.

7) Enjoy playing the updated game.
I updated tons of games yesterday with only booting it to OFW, why removing the SD card?
Nintendo can't track games app without the card inserted, that's why they ask to insert the card if you want to redeem your Nintendo's points

I have auto RCM but only got the OS license no dongle. Left my Switch online while sleeping, still not banned.

--------------------- MERGED ---------------------------

That's how I'd think it would work. If I unlink my account now and my console gets banned in the future could the account it was linked to in the past get banned when the console gets banned?
If you unlink they can't ban your account....it's the same as if you unlinked to sell the switch

Yes your right I believe its rubbish! I have been updating through SX OS CFW Autorcm activated all the time and I have not received a ban, my opinion is I still think most of these bans are stemming from using previous CFW builds and using layedfs or something else, using cheap bad media anything like this could flag a ban, it could be from a multitude of reasons we don't know for sure I have used my sd card solely with SX related files, careful with certificates etc.. nothing else I have just done as what TX told us in the updates rolled out and I have had no ban. I think trying to blame SX OS for all these bans is ridiculous! Its a case of "I used SX OS last before my ban so it must of been that!!" I bet if you asked all these bans I'm sure none would say I solely used it for SX OS with my ban I bet the sd card had been used for CFW before hand, the sd card probably still has the same cfw files left on it and using SX OS on the same card! apart from your "switch" folder nothing else should be on it! it should be a fresh install.
