And who cares if it autoconnects to a random network, you'd be using SSL/TLS anyway for "important" websites -- plus even with legitimate APs you'd be trusting the provider anyway!

Use my AP for your banking then. I promise the TLS will protect you! Does anyone pay attention to cert errors anyway? Does the 3DS browser even display https errors? Auto-connecting to unknown & untrusted APs is a big deal.

i think the only thing people use the 3DS browser for is to visit go.gateway-3ds.com or pokemon hacks etc

other than that, i doubt many/any people do their online banking etc with the 3DS......bet more than half the people who now use the browser for gateway had only ever launcher the 3DS browser like once before, leaded a few pages, went ..."meh, crap" and never looked at it again

it worked for me, tried it today or yesterday (now i dont remember) update didn't botered anymore :D

(but even before it didn't botered much, and keep in mind i have REAL NAND at 9.4, so there is no big point to not update)
