Well, I'm pretty sure any method to make backups is not legal...
It's against all system maker's terms of use, but not illegal in any city, state, or county here in the USA. So long as your copy of the backup is actually yours, it's frowned upon by authorities, but not illegal.

Considering how wrong you were about the state of emulators on the 3DS, I'm going to assume you're incorrect.

Legally made backups aren't illegal to play. :P
What backwater hellhole are you from? Brazil or something? You can play your own backups as much as you want so long as you made them and do not distribute here in the US.

While downloading them is still deemed illegal, you should note that it's not technically piracy if you own the copy. So if there is ever any investigation for illegally downloading ROMS, you got to have proof you own a real copy.
When you use a 3DS you agree to Nintendo's usage terms and those are legally binding. Nintendo doesn't allow you to make backups of your games so in turn it's illegal.

As far as Australia is concerned, you can with certain media back up a private copy for yourself as just a backup if you own the real thing. Technically the software itself in a game is allowable under this, however the bits owned by nintendo e.g. characters, graphics, music ect. is not allowable.

The obvious exception to this is games that don't include this under their terms and conditions.

No one reads those things. I never connect to Nintendo's servers and use them for anything. If I even connect to any server, it's my own to host some MK7 with friends. So, once I walk into ( input store name here ) and buy a 3/2ds, and I walk out with it, it's mine. I can exploit it if I want. I'm not correcting you on laws, I stating basic human rights. I may modify my 3ds to my hearts' desire so long as I legally paid for it. [Legally binding]? That's Nintendo's legal info. Not actuall legal information. You're breaking Nintendo's Law by dumping ROMS.

Owning a physical copy means nothing regarding a ROM you have unless you can prove that you made the ROM copy yourself from the physical copy.

Contradiction post. That's exactly what I just said and meant. If I download a ROM, it's illegal. If they investigate my home for this, and I prove I own it, they will leave as it maybe illegal, but also legal in a sense because I already own the game. No law says I must use my own software to dump or obtain it.
