Hardware 3rd party hdd and xbox emulation

I have an Xbox 360 slim. I'm getting a 3rd party hdd and I know that you can not use the original xbox emulators. Just to make sure though, If I plug it in to my computer with transfer cable,Download a partition 2 backup, open it in xplorer 360 I can put it on there and be able to emulate the games? Is there a chance Microsoft can tell if I do this and ban me? (I know they don't like mods)

Yep it'll work, as long as you download an official HDDX partition (or dump your own if possible) and not the hacked one.
Nope they can't ban you.

MS has no way of telling if a HDD is 3rd party or not.

You should be good to go yep.

It might be that you'll need the last update for the Xbox emulator but I don't think so.
If it doesn't boot a game which is supported then grab the update from the MS site and let it update ;]
It might update itself via XBLive if you put in an original xbox disc and boot it.
