The pictures for that item show that it has the hinge parts on it. I don't see why it wouldn't work for you.

You can do JUST the hinges, but it's a pain in the ass.

https://www.ifixit.com/Guide/Nintendo+3DS+Cameras+Replacement/6175

If you look at this guide, they do remove the hinges during the repair process, so you could follow up to that step to see if you think you could do it, or if you want to just get the whole top case bit.

Id rather just replace the entire middle part that includes the hinges.

That looks like a right ball ache.
have a funny feeling though that

http://www.ebay.co.uk/itm/3DS-XL-Re...772647?hash=item3abe4c4527:g:xKcAAOSwDuJW0A33

only includes the plastic shell surround and not the hinges...

To be completely honest, it might be hard to find an assembled top half. It's a bit annoying to find the entire part already assembled. I'll look for some links.

edit: Just saw your edit, yes that does not include hinges.

I don't see those parts having the hinges either. These bare shells require you to transplant EVERYTHING. so you'd have to rip out every component and probably move the hinges over when you swap the screens

edit: does your hinge work? As in can you open the top half and let it swing around outside of the broken bottom half? It looks like to me your actual hinge is NOT broken. I hand't looked at the picture. so the only thing you need is the bottom half

My hinge seems intact?

Right! I just saw that. Since your hinge is good, I'd bet you can just swap the bottom housing so that WOULD work for you. For some reason I was thinking that you had an actual broken hinge. That bottom part will work for you since that's the only bit thats busted.

So I should be able to get away with just replacing this

http://www.ebay.co.uk/itm/3DS-XL-Re...772647?hash=item3abe4c4527:g:xKcAAOSwDuJW0A33

Does the entire thing still have to come completely apart to replace it, pretty sure it does...

Yes it does.

http://www.ign.com/wikis/nintendo-3ds/3DS_XL_Shell_Swapping
That's a link to a decent-ish guide. A video would probably be better.

By the way, if you wanted ifixit also has the entire part as an option for much more money, but you have to swap everything still. https://www.ifixit.com/Store/Parts/Nintendo-3DS-XL-Mid-Frame-and-Digitizer-Assembly/IF258-000-1
