I wanna download Netflix from the eShop, but the eShop keeps telling me that I need to update. Is there a way around this?

yes you can ALWAYS update the flashcards acekard/dstwo (but if you have a r4 SUCKS TO BE YOU they take a wile)
Not really, r4ids.cn gets updated with the new firmwares pretty much on day one.
sry my r4 (r4ids.com) get updated 1-2 weeks after the update (thank god my r4 broke)
The only way to get the eShop to load without updating is to sideload a spoofed version of whatever the eShop checks to see what firmware you have and this will not happen until the 3ds is hacked.
And given that the Nintendo eshops always happen over https, and both the client and server verify each others certificate, it is more like never. The best one can do, once 3DS is hacked, is selectively update just individual components. That approach has a plus that one can grab the shop, the system menu, and everything, except the stuff one doesn't wish to update, specifically the component that allows Nintendo to block flash carts.
On the DSi, it is possible to spoof the http server part of the update, where it downloads most of the top level stuff, which is settings, system menu, and shop. Next down, is the title that blocks flash carts. The spoofed http server can just simply return a 404, and stop the update at that point. Not sure if that would work on 3DS though, or if nintendo got smart enough to make updates happen 100% over https.

Yeah, you could do it the wii way, selectively updating the necessary components. Anyway I think nintendo did fix that, I tried doing a partial update and it wouldn't flash it until the entire update was downloaded and verified by the console.
Here is why the 3DS refuses to do partial updates. What is really happening on the 3DS when you request an update, is they did in fact change how the 3DS queries the server. What happens is 3DS queries server. Server replies with a HASH of the current version. 3DS verifies installed version against this HASH. If it differs, then the 3DS will request the FULL update from the update server. 3DS downloads full update. Any stoppage of update, and it won't bother installing it, as it won't match the new hash. Once it has downloaded the full update, it verifies that it matches the hash, then proceeds to install the update. Effectively, Nintendo killed our ability to spoof the update server and do selective partial updates totally. Shutting the 3DS down part way, means nothing of the update is installed.
