I wanna download Netflix from the eShop, but the eShop keeps telling me that I need to update. Is there a way around this?

And given that the Nintendo eshops always happen over https, and both the client and server verify each others certificate, it is more like never. The best one can do, once 3DS is hacked, is selectively update just individual components. That approach has a plus that one can grab the shop, the system menu, and everything, except the stuff one doesn't wish to update, specifically the component that allows Nintendo to block flash carts.
On the DSi, it is possible to spoof the http server part of the update, where it downloads most of the top level stuff, which is settings, system menu, and shop. Next down, is the title that blocks flash carts. The spoofed http server can just simply return a 404, and stop the update at that point. Not sure if that would work on 3DS though, or if nintendo got smart enough to make updates happen 100% over https.
Yeah, you could do it the wii way, selectively updating the necessary components. Anyway I think nintendo did fix that, I tried doing a partial update and it wouldn't flash it until the entire update was downloaded and verified by the console.
