    True, but considering that Luma is the recommended CFW by the guide and that all other ones are either dead or haven't been updated in ages I don't think many people will care about that. Plus if you want to use one of those you can still use CIA homebrew, unless what you want to run is only available in 3dsx but that's really rare (or you could grab the source and make a CIA yourself, which shouldn't be a big issue as those alternative CFWs are developer-oriented anyways).

    So, yeah. Your average user is pretty much only going to use *hax to follow the guide, then forget about it.

    I've been out of 3DS scene for a while. So Luma is still a thing? Nintendo doesn't ban people for playing online anymore?

    Luma is the only currently active CFW. Nintendo has only banned people in "one and a half" banwaves (aka the first big one and occasional users who played leaked games online before release, whether they were Pokémon or others). That aside, no one has been banned for playing online with CFW even with pirated games: unless you're doing blatantly stupid stuff, you're fine.
