someone else told me they somehow got Nintendo Badge Arcade on their home screen and they haven't deliberately gone and download it themselves.

I got it after I left my 3ds in sleep with wifi on 10.1. but I cuoldn't use it w/o updating, so I updated LOL

anyway I think that its one of the ways nintendo pushes you to update your 3ds
