    Not really. The game can't detect what you send in the GTS. The only way to get banned is either by genning multitudes of items (people have reported being banned for this), and by illegally obtaining the game before release.

    Hey guys, I recently discovered how to send many illegal shiny event pokemon through the GTS, with only a few exceptions. Here is the download link for the event pokemon. If you manage to send a shiny event of your own that is not on the list, don't hesitate to respond!

    (sent, just in case the other one does not send) Bomb should take 15-120 minutes to send, and make sure you are on sleep mode/playing a game. Also make sure special notes is enabled. Complete the final step of this guide as well, if you haven't already.
