    Thanks for all the advice guys, I bought a used console for $300 plus Mario kart for $60 and I'm pretty happy. I'll buy some controllers down the line as well. Planning on keeping it 5.3.2 which sucks since that prevents online play/dlc but that's the price you pay I guess.

    Yeah I'm pretty sure that the SD card was the same, however on the old console I tried booting without the SD card and got the same problem.

    this may still be the issue... assuming all you need to do is put it in once to trigger the glitch... on the old console it still happened when I removed it and restarted etc... Nintendo probably did put the old SD card into the new 3DS... My bad I should have checked before I rushed it back...
