Nintendo used the TX court case to "send a message", Gary Bowser's health potentially at risk in prison

Gary Bowser, of Team Xecuter infamy, is still serving his three-year prison sentence. The storied court battle may be over, but a new court transcript was released, and uploaded online, courtesy of Axios. In it, is further official comments from Nintendo's lawyers. According to the document, Nintendo's legal team wanted to use the TX case to send a message to other would-be hackers or those in the piracy business. During the proceedings, US district judge Robert Lasnik asked Nintendo's lawyers, "What do you think? What else can we do to convince people that there's no glory in this hacking/piracy?", with Nintendo's side responding, "There would be a large benefit to further education of the public."

Lasnik agreed with the sentiment, though he did not sentence Bowser to the full 5 years that Nintendo was seeking. "I always tell the jurors, 'Your role is not to send a message. Your role is to decide guilt or innocence on the facts'. But my role sometimes does entail sending a message." In response, Bowser said that giving him a longer sentence wouldn't be a deterrent to hackers, stating, “There’s so much money to be made from piracy that it’s insignificant.”

Additionally, the legal documents also reveal that Nintendo blamed hackers for the release of the new Nintendo Switch model, saying they had to design new hardware to circumvent the losses caused by TX. Nintendo's legal team also claimed that those using hacked systems could cheat, thus scaring off children who would lose to the cheaters and feel upset. “Parents should not be forced to explain to their children why people cheat and why sometimes games are not fair, just because one person wants an unfair advantage.”


Regarding the means of "sending a message", Bowser's lawyers sought a shorter 19-month sentence, to which Lasnik disagreed, and eventually sentenced Bowser to serve 40 months. The amount sentenced would have initially been 60 months, but was shortened due to the fact that Bowser suffered health issues as he awaited trial in jail, which caused him to be alone in solitary for 23 hours a day over the course of six months. As this also took place during the height of COVID, Bowser would only be allowed out of his cell to shower once every three days. He also had lost 90 pounds over those six months, and was confined to a wheelchair, as a result of his illness going untreated.

This was Bowser's statement regarding the above: "It has been a very traumatic experience for me getting arrested, coming here, going through this. This is my first time actually in a jail going through the court process and everything. And the amount of time I've spent already, 16 months in custody, a lot of that time - I spent six months, basically, locked up due to Covid. I went through all three of the Covid waves before there was even a vaccine available. I personally haven't got the vaccine [as] I am skeptical with my medical condition, how it will affect me, and I haven't been able to actually have proper medical treatment because I haven't been able to have a one-on-one with a doctor to see if the vaccine would be possible with my health conditions. When I first got arrested, I was 410 pounds. I had to use a wheelchair. I spent my life drinking, since I was age 15, after my mom died, and this is the longest time I have been sober in my life."

So, basically, this dude got 3 years of prison time, and over 10 million in legal fees and fines. Screw around and find out, indeed, but if anyone thinks that's a fair judgment handed out by the legal system, then you're crazy. The fact the judge was like, "well, how do we make it look super super bad to wannabe criminals and make this loser pay for it, any suggestions mr nintendo?" is pretty telling of the situation. He's not innocent, and I'm pretty sure he argued as his own lawyer or something, but are we really going to be like, "lmao, man did petty crime, hope he's ruined for life and doesn't get medical treatment, muh freedom!"???
Was it fair? Of course not, he was just the fall man for the entire operation considering he was in a easy to access place where the fbi could arrest him for any goddamn thing they wanted. Are people advocating for no medical treatment people who would throw fits if they were put in the same situation? Most likely.

but you have to admit, you have to be a little stupid (and a little ballsy) to advertise a device that can pirate nintendo games somewhere where nintendo can get you and have you put in prison for years.

Funny that their go to is "THINK OF THE KIDS" when kids are probably the largest users of online cheats from my personal experience.

We all like to stereotype cheaters as fat sweaty neckbeards with no lives that cheat to annoy people (and there definitely are people like that) but I've personally encountered more children using cheats to pretend they're skilled.

If you don't want your health to be at risk in prison, don't willfully violate the law repeatedly. He's right where he should be, and is getting free healthcare.

Not to be mean but they sold the hack, others released it for free and I think he's on the right place.

Without TX nobody would be able to mod their OLED or Light switch's. If TX were still active we would have a cheaper and likely easier solution than relying on the current clone that we have now

Shhh....Don't say that. I'm sure they only use LEGAL HOMEBREW and LEGAL EMULATORS. (just don't question where they got the roms from ;))

Why he could get extradited because of a Japanese business, to the US (Their US branch) is simple. They sold it worldwide. If he just sold it in a dinky shop in the DR, this wouldn't have happened. Because then the crime would have happened on DR soil.

Gary was the smart man to go after also, he was the transport man/Seller after all.

If TX did not engage in blatant piracy and did not include content copyrighted Nintendo would have fewer spikes to hammer in making legal case. Sadly they got greedy and this is the end result.


Laws can be different between countries but there have been past precedents that producing third-party modifications for software and hardware is theoretically legal if it does not include content copyrighted by the original vendor.


Someday we will probably see an open-source mod-chip for Switces invulnerable to RCM and at that point the cats probably out of the bag.

It also sets a precedent for more things like this to happen. If Nintendo and other copyright holders can establish an indisputable connection between homebrew enabling devices/software and piracy it's easier for them to shut everything down and keep us locked into only using what they give us, which means they can charge more for inferior products.
As if they aren't doing that already?

The last time Sony try to send a message like this, it work quite well. There is no more hack on Sony console after that and no emulator of their newest console PS4 on PC.

Really? That happens almost all the time on PCs; what, is Microsoft supposed to send out an anti-cheating OS? Are laptop manufacturers supposed to add anti-cheat measures to their machines?
That's not an argument.

Also, that's not a humane way to treat Gary, people; he should've been looked after and kept as healthy as possible - what is this, a concentration camp?

It really shows what's important to those in charge: money. That's all it comes down to, and people are so easily motivated by money and fear. Yeah, okay, so they promoted piracy which lead to some people not buying some games. Yeah yeah, that's wrong. But why not go another route and try to work something out with TX? Why not make some kind of deal where they're allowed to keep operating as long as they don't enable piracy on their devices? I know, not a very good deal but just an example.

Instead they lead with fear. All hacking is piracy! Piracy bad! Put bad man away, make other bad people stop!

Except they won't. It's such a naive way of looking at things and until companies like Nintendo get their head out of their arse we won't be any better off in general.


Also, obligatory "the health care he's receiving in prison is probably better than paying a doctor $800 to spit in your eye and call you unhealthy (or whatever goes on in the USA) comment

This entire part sounds like a joke. Including the motivation for a new model.

That's not an argument.
We are already headed in that direction on PCs. TPM 2.0 is required for Windows 11 to ship on OEM machines and online games like Valorant are using it to ban cheaters. It would not surprise me as more and more games turn to microtransactions that developers and publishers will turn to Microsoft to help combat cheating as it is costing those gaming companies real money with cheaters.

Imagine how much money Rockstar thinks they lost to cheaters in online giving themselves billions of dollars bypassing spending thousands of real dollars on Shark Cards to get that much money ingame.

Too many people here think he deserved it. Yeah obviously he was profiting off nintendo which is illegal as shit, but rotting in solitary is not the way. I'm sure a lighter sentence would have been fine. I really disagree with the heavy sentence on this one.

If ninty keeps being allowed to do this bs, in the future it will escalate, and then all gbatemp will be arrested, see you there in prison.
Also I don't remember when was the last time I've bought a Nintendo game in any form... 2018? (When I bought the switch and Zelda along with) but I've played many ninty games since then, heh.
Honestly this exact scenario I just cant see out of the realm of possibility. With everything that's going on in the world, I just cant rule it out. Wanna be cellmates?
