Dbrand no longer selling PS5 faceplates after Sony threatens legal action

Selling faceplates for the PlayStation 5 seems to be a lost cause. Last year, a storefront called PlateStation, which was selling customized faceplates for the PS5, was forced to stop after threat of legal action from Sony. A few months later, Dbrand, known for their tech decals decided to get in on the market, by offering their own black faceplates called "darkplates" for the console, even going so far as to joke about the matter by advertising them and saying, "go ahead, sue us" to Sony. The latter took it seriously, as they've done just that. A cease and desist order was issued by Sony to Dbrand, which resulted in the latter being forced to remove their PS5 faceplates from sale; if you now attempt to visit the store page link for them, it redirects you to a list of news reports specifically about Dbrand taking the darkplates off the market.

Quotes from the letter were posted by Dbrand's marketing team to the brand's subreddit, with a breakdown of the incident from their point of view. Sony alleges that the shapes used on the darkplates infringe upon their trademarked PlayStation face button symbols. Dbrand clearly uses a cheeky spin on the PlayStation look by using the same square, circle, triangle, cross look: a cross-shaped skull and bones, a circular radioactive symbol, a square robot head, and a triangle with a rune in the center. That isn't the only issue with the darkplates, though, as further on in the letter, Sony's legal team mentions that "the two vertical faceplates has become exclusively associated with [Sony] in the minds of consumers, and has come to symbolize considerable goodwill", meaning they find the sale of third-party faceplates to be an issue regardless.

Quote from Dbrand:
While we strongly believe in the consumer's right to customize and modify their hardware with aftermarket components, your Darkplates are now a collector's item. You know what they say - you either die a Darkplates owner, or you live long enough to see yourself become the scalper.

In closing, fuck you and especially fuck Sony. Talk soon.

I really wish that they should've gone with something like a hexagonal pattern or some other geometric patern for the vent instead of the crosshair and concentric circles.

am i the only one worried that the new designs are worse? sure the console will get coller but the ammount of dust that has a direct acess to the ps5 he console is not running seems it will be worse in the end imo, that vent is too big, lots of dust and other small crap will just straight up enter when the console is not running and build in there.
They did say that you'd get mesh grilles for that.

These guys are absolute Chads! One day they're down, two days later they're back up and running with a sleek and functional design and some snarky comments directed at Sony. Here's hoping they can keep their business going without Sony pulling another Nintendo.

And Sony deserves every bit of being called out too. Greedy, litigious bastards lol.

If they were going for an original design, I would have liked to see a plate which can support the console when horizontal without the stand.
Same. I would get them for the disc edition if they came out with a special left side plate that mimicked the disc drive on the right. That way the whole thing could be symmetrical when standing even if one side was just a dummy bulge.

Since Dbrand introduced the new version of their plate not long after getting the C&D, it is very likely all the stuff prior are just for marketing purpose (ie. the first version of their plate and daring Sony to sue them). That's some 4D chess Dbrand is playing. Well done I will say. :rofl2:

With the mesh grills I'm not worried because I use them on my PC and they work great. However, with fan noise issues being a common thing with certain fan models used the the PS5,... won't these make it even worse for those people? Won't the vents make those with the fan noise even louder/easier to hear? I could hear the "ufo" fluttering sound on mine from 8 feet away on my sofa. I can't imagine being able to tolerate it being even MORE noticeable.

can't believe nobody has f***ing balls to stand up to $ony especially when it's nothing illegal
It sounds to me as if Sony's lawyers made a reasonable argument, which is why dbrand changed up and went to 2.0.

I assume they were trolling Sony.

dBrand can suck a d. They offered free shipping on orders over $25, but charged me shipping for my order of 2 Darkplates. When I contacted them, they said they do not give free shipping on combined orders. Like wtf? If I ordered two of them in separate orders there is free shipping, but ordering 2 in one order does not qualify?

They also are refusing cancellation because:

"Cancellation / Returns: Except for any statutory rights of cancellation that you may have under applicable provincial consumer protection laws, once you place your order you cannot cancel."

Guess I should have looked at their TOS prior to ordering. But seriously, fuck these guys.

You probably will get a better response if you called them out on twitter pr other social media. Their shipping sounds like a trap based on your description. Hopefully Sony's lawyers can sue them on this front so they can cancel the product againd and u got refunded lol.

I emailed them back about the denial of adjusting my order for free shipping. If they deny it again, social media here I come.

Edit: So they begrudgingly separated my order and refunded me the $8. Nothing more I can say about it I guess, except that I kinda wish I didn't order. After seeing the new design for a few more days, I don't really care for the added vents. PS5 was probably designed with a certain air flow in mind adding extra holes on the top and bottom would defeat the initial intention. Even if that wasn't the case, the increase in fan noise I spoke of earlier is unappealing in itself. Oh well. It was Less than $130 for 2 of em. Not like I blew a couple grand or something.
