Sony may be sued over limiting its digital game sales exclusively to the PlayStation Store

Sony is set to possibly face legal troubles, regarding how it handles digital game sales. A class-action lawsuit is in the process of being filed, attempting to take action against Sony's alleged monopoly over digital game sales on its platform. In 2019, the company stopped allowing retailers to sell digital vouchers of PlayStation Store titles, and according to the lawsuit, this means Sony can charge whatever it pleases for its games, potentially hurting consumers due to a lack of market competition.

Sony's monopoly allows it to charge supracompetitive prices for digital PlayStation games, which are significantly higher than their physical counterparts sold in a competitive retail market, and significantly higher than they would be in a competitive retail market for digital games.

The suit also alleges that there have been instances where consumers have had to pay 175% more for a digital copy than a physical one. For right now, the class-action lawsuit is only being proposed, and if it moves forward, it'll be filed in San Francisco, California, under the case of Caccuri v. Sony Interactive Entertainment, in the US District Court of Northern California.

Damn, everyone is suing everyone.
Is this year the suing simulator year?
I bet an indie developer will be making a game like this as we speak.

People seem a bit confused: they're being sued over the fact that places like HumbleBundle and GMG can't resell digital game keys/vouchers. Not over the fact that Sony games are exclusive to Sony consoles. Humble sells digital Nintendo games for redemption on the eShop, but their prices aren't really any lower.

People who don't have hacked consoles, non cheap asses who can afford to buy at least some of their games, etc. A lot of people. In fact, more people pay for their games than not.

Oh for a moment I thought this meant Square enix, Capcom and others would finally be able to release their ps1 games in other platforms without having to remake or remaster and rerelease them as a new thing

All they need is the source to the game and then write their own code to replace the ps1 sdk libraries.
It's been done already.

I'd be pissed about that if I was anyone other than Sony, too.

Sony have every right to piss you off and you have every right to be pissed off.

That doesn't mean you have an actionable case, any more than if you tried to sue me because you're pissed at my reply.

It's odd that a digital download is more expensive than a disc, but then I don't really understand why people buy the digital downloads in the first place let alone spending more money on them.

sony should just sell the digital games to shops at the same price they sell them at retail, there is nothing that says they have to charge anyone any less.

This is wrong on so many levels. Let Sony sell their exclusive games; we don't want to force them to sell vouchers if they don't want to. That would open up Pandora's box on mandating digital sales - which could include introducing taxes! :wacko:

I wanna play ps1/2 games on my switch, but it seems Sony keeps them on a very tight leash....
I would think that's perfectly possible as it is. Plenty of developers rerelease old Nintendo (NES, SNES, Game Boy, etc...) games on newer, non-Nintendo consoles, and all that really involves is stripping out legacy "Licensed by Nintendo" stuff. Is the PS1 any different, in that case?

Nah if anything there's incentive to price the games lower on other storefronts, but most likely they'll be about the same. Consumers can only possibly benefit from more competition among digital resellers.

the eshop adds the same 13% tax on digital sales as physical stores do and it's stupid, the PSN store and steam don't tax

Steam taxes me, and I'm American. Only Oregon and Rohde Island don't have any sales tax here. It's 8.4% for my state. (WA state)

Last time I'll post this in this shit topic. Disc is not always cheaper than digital. Over half of my digital games I purchased because they were cheaper than buying on disc, even used. To many people also acting like Sony are the only ones that ever sell digital at full price when a disc can be purchased for cheaper at say Walmart. Happens with Nintendo and Xbox every bit as often so.....

Hmm I am sorry but I smell Irony because Nintendo is still selling Mario Kart 8 (Wii U Game) For $59.99 and that game is over 7 years old. I feel those people are going to lose the lawsuit because it is going to be very hard for a company to micromanage all of those games. Sony usually price their games very fairly and the do have on sales....

People need to be suing Nintendo lol

I don't really see the point . . . why would i want to buy PS games on the xbox store, epic, steam or whatever since it will just make it more of a hassle to install it on the playstation in the end since you still need to get them on your PS somehow afterward.
They aren't talking about port here but playstation games being sold only on the playstation ffs!
And their price too high compared to the super competitive physical market . . . wut lol.
Like buying a used game in a store for 10 bux or getting the same game but complete edition for the same price as the store coz its 80-90% off on the PS store which is often the case . . .
Yeah this has to stop rofl.
In the meantime Nintendo is selling 5+ year old games at full price both in physical and digital stores and once in a while gets a whoping sales 10-15% off!!!! Woah!!!!
I dunno, i just find this class action dumb . . .

This is one area where Sony is more regressive than Nintendo, since Ninty does allow third-party sites to sell eShop keys. Though I'd certainly agree Sony prices their games better overall, even despite the roughly 10% discount third-party sites bring with them.
