Banning hardware is effectively bricking the switch most Games these days need latest firmware and updates to play . if they were to start banning switches that actually did nothing wrong I couldn’t begin to imagine the legal uproar.. ofcourse they could but legally they won’t
You know, someone with a banned console already has the means to do everything an unbanned console can do. Heck, a banned console usually sells for more than unbanned consoles because when people are buying used consoles, they are usually looking for an exploitable one which is guaranteed if the console is already banned. If they wanted a new console that may or may not be exploitable, its just better to buy officially than used; the few bucks you save isn't that significant.

Not on an unmodded Switch that's never violated any terms... That's what he's saying.
However they can and will ban you from CDN on any console that has been connected to the same network if you pirate stuff from CDN. That is just a CDN ban though and not a system-wide console ban IIRC.

It's best to keep it on FAT32, the chances of corruption are orders of magnitude lower.

You can still update the firmware unofficially so that's not really an issue.
So you think I should leave my ofw untouched on firmware 4.1.0 fat32 and setup emunand on the latest firmware with ChoiDujournx and do it that way? If I update emunand to the latest firmware with ChoiDujournx how will that affect the fat32 sd slot on ofw when emunand will be changed to exfat or does that just update the exfat on the hidden emunand on the sd card? I have got another switch for online activity that was the point tbh, it just so happens the brand new unit I bought was exploitable and on 4.1.0

Yes, if your Switch is currently clean, definitely set up an emuNAND for all your CFW needs so you can keep your sysNAND clean. It's a good idea to make a NAND backup with Hekate first of all though. Do a full rawnand backup and boot0/boot1 backup, and just for good measure, do a backup of eMMC sys as well, as it can sometimes be better to just restore that partition, in case you do something dumb and brick it for example, restoring just sys would keep your saves and games intact. Technically you just need eMMC sys and boot0/boot1 backups but I like to make a rawnand as well since I have room for it on my NAS.

You don't need ExFAT, ExFAT is orders of magnitude more prone to corruption and there is nothing that needs it. FAT32 is just fine on the Switch. Your sysNAND is now not 100% clean anymore (but at least you have a clean backup) and shouldn't be used for online. Not that you can use online on 5.1 anyway, I guess you can just restore the NAND backup if you ever want to use online.

I updated my Switch officially (with the exFAT update) right before I hacked it. Obviously you should not do that on an unclean/nonlegit NAND.
Make sure you keep your Switch offline since both NANDs are unclean and if you really need to use wifi make sure you use 90DNS to block Nintendo servers (but Nintendo could change stuff at any time so that 90DNS no longer blocks everything so it's not a 100% guarantee of avoiding a ban), if you have already went online in CFW or on an unclean NAND you may or may not already be flagged for a ban and there is nothing you can do if that's the case.
You can update from a cartridge/xci but do not update online. ChoiDujourNX is probably your best bet.

So if have read that there are also Account-Banns but they are much different than normal banns. So as long as you are banned normaly, everything should be alright.

I left it in the end I created another fresh account just to make sure I have most online games like Splatoon 2, MK8, Arms etc.. all on cartridge so it wasn't worth it and that was the main purpose of purchasing another switch in the first instance, only for online feature games. I have noticed all my games on firmware 7.1.0 now need verifying before boot up I have seen this before but only on the Nintendo Online App, not retail games? they all check out fine on boot up but how come this has to be done on retail games, is it some new security check they have now implemented on firmware 7.1.0?

Thanks for this topic, i was looking for this answer, because after a year using SX OS i got banned, and i'm planning to get a new switch, yet i was depressed that i would lost all the games i bought with my account, and all the progress i had with mine, but i guess if i buy a new switch, i can use my account, and so get again my games, and my progress in the games i use online like CTR, splatoon 2, etc.

Hi! After almost a year of this post, accounts are still not bannable? My switch was banned. and im thinking on buying a new one. Is it still safe?
up until now, no bans, I've even shared my account with my friends and they aren't banned either

Two days of using my old account that was linked to my banned switch on a new switch lite. So far, not banned. I made sure to deregister my old console on the shop menu section of my nintendo account settings. I now have one switch for hacking and another for online play.

Ok thanks. Did you check with Nintendo or anyone first or did you just connect the account to your new switch and hope for the best outcome?
nintendo only bans NNID's in extreme cases such as online cheating

Hi everyone I’m glad I found this thread. I just recently linked my old account from my banned switch onto a new un-banned Switch and I hope that it still continues to be safe. I was able to re-download a few legit games from the account such as Rocket League and Golf Story and I could not be happier. Although just to be safe, I went ahead and deleted my play activity lol I know it won’t matter but I just like not seeing all the backup games I used to play that got me banned. Cheers!

This thread is a few days old, but I want to share my experiece with using an account on a new switch which was on an banned switch. Maybe this can help a few people.

When I got banned, I started a job and bought a console-only switch (which is luckily unpatched). On it I created a new user and linked it to my old account.

Back in the days, it wasnt possible to re-download purchased games from the eShop, because this new switch wasnt the main-console of this account and the only way to change that was by going into the eShop on the main-console... which was banned, so it wasnt possible. A few days after I realised that, Big N made some changes and it was possible to change the main-console on an official website once a year. Heres the link if you have that issue too: Unregister

Another issue was my play-time of games on my account... it froze. I had 600+ hours in Splatoon 2 from my old console and after playing 10 hours on the new one it didnt change. New games which werent played on the banned console would behave normally.
After around 1,5 years I resetted the playtime on the switch in the user settings and then it worked again, but there was something weird. This is what I found out: In the background the play-time of Splatoon 2 was still counted on the new console, but didnt updated on the user. By resetting the play-time, it changed the play-time of the user to the time of the new console. It didnt added the new time of the background, it overwrote it. An example:
I played 280 hours MK8D on the banned console
I played 250 hours MK8D on the new console
Before resetting, the user showed the play-time of the banned console
After resetting, the play-time of the user changed to the new console and would now count new hours (So the user showed 250 hours)

About bans: my account was on a banned console 2,5 years ago and is still not banned. I think it would be very random if Big N would now ban accounts of banned consoles.

Nintendo rarely bans accounts, if ever.
