I'm probably going to regret this, but here we go...
... You just want people to use their projects because you think that fans do a better job than them? I dont see any logic in that. If people dont want to start from the ground up, that is understandable, but just going to steal other IP because you dont want to start from the start is not a best move to create some engaging interesting content.
Here we see a case being made AGAINST fan content.
... its your product, you do whatever you want because its your property. Hack, it, mod it, whatever you think that is fine, because you are the owner of the console ...

Mate, that was an example what you can do with something you buy, in no way im commenting its good. But i guess people in the end will do whatever they like and later cry when they get a ceast and desist letter. No matter what, all of Nintendo IP'S are their properties and you just cant do whatever you want because you want to do something with it.

No...? In fact, I'm sick of when people compare shit like CTGP and Project M to Nintendo's games and act like that makes them better than Nintendo. But for just a basic piece of art or a story never meant to rip Nintendo one? Ehhh....
People think that they can get away with stealing properties from Nintendo because they are family friendly. Its their products, their parts. The same as you buy a Playstation console or a Switch console, its your product, you do whatever you want because its your property. Hack, it, mod it, whatever you think that is fine, because you are the owner of the console. The same applies to Nintendo, its their work, people cant just go and steal their projects because they feel like they need to steal it.
That would apply if someone took a game, made a ROM of it, and started selling it as an alternative to Nintendo's storefront. Drawing fanart / rendering fanmusic / writing fanfiction is not the same as theft.

That can actively hurt those mods, too, very sadly. I know from experience with SPV3 that folks who make comments like that tend to mean well, but don't realize it potentially galvanizes large amounts of people against it preemptively. Mods like CTGP, Project M/Legacy, SPV3, they are companion pieces to the original. Without the original, you wouldn't have your awesome mod.

That would apply if someone took a game, made a ROM of it, and started selling it as an alternative to Nintendo's storefront. Drawing fanart / rendering fanmusic / writing fanfiction is not the same as theft.

I just dont understand why people feel the need to use a properties that its not theirs. Nintendo have all the right to do what they feel is right, just respect their properties. In the end people dont do it just for free but to gain something from it. Publicty, to make a name, to have people donate to your project. Who would spend countless hours doing a project for nothing? No one. If i create a fan project containing Nintendo projects, and my channel is monetized, and lets say you have lots of view on your page, you are making money.

Easy: because they want to. Project M was literally made because fans didn't like how different Brawl was from Melee and wanted to take matters into their own hands.
Publicty, to make a name, to have people donate to your project. Who would spend countless hours doing a project for nothing? No one. If i create a fan project containing Nintendo projects, and my channel is monetized, and lets say you have lots of view on your page, you are making money.
If your channel is monetized, because if it ain't, newsflash: you ain't making a dime. And I would hardly call only getting people to talk about your project despite not making any money off of it, or its bigger brother of reconsidering how people perceive IPs and the companies that own them, "nothing".

This not true at all. There was a person doing some Legend of Zelda project, i dont remember his name and got his channel suspended, he was making money of it through Youtube. He used the Real Engine. I cant wrap my mind how people can be so defensive about stealing someone elses projects, like they own it or have every right to use while its not the case.

Nice reply, says it all. Looks to me that you want that people use their properties just because, without any consequences added to it. if that was the case, anyone could do a fangame of every game that is out there without any problems. Heck a fully fanmade Castlevania would have been great, or a Resident Evil game created with a new Umbrella story. We both know that something like that isnt possible without the consent of their rightful owners.

Here's the thing: Nintendo has the legal right to prosecute everyone and anyone that uses their IP without their permission. This can range from someone using a Nintendo character on their bakery shop to a videogame publishing company including Mario in one of their titles without Nintendo's permission.

And then the issue of copyright:

I mean, even using a profile image with a Nintendo character is copyright infringement, and so is uploading gameplay videos under most circumstances, even if youtubers insert a "fair use" notice at the beginning of the video. Sharing memes that feature Nintendo characters is also copyright infringement. Nintendo could very well strike these down. There'd outrage, but they're within their legal right to remove from the internet (or any other medium) any unauthorized reproductions of their IP. They're protecting it from "pirates", after all. The first Super Mario game was released in 1985, which means it'll enter the public domain in 2080, and that's assuming the Congress of the US doesn't approve any more retroactive copyright extensions. That's insanity.

This isn't a problem with Nintendo, this is a problem with copyright.
