Hacking Question So why exactly can't we dump eShop games?

Can you even use a console cert from a banned Switch to access eshop via CDN downloader?
Nintendo can't really ban you from this without getting in Legal trouble,
because if you delete an update of a retail Game, you could never play your physically bought games again.
(Since they need you to re-download the Update)

You can even still access the eShop and buy stuff (on your PC) with your banned console,
so technically Nintendo only bans you from Online Play and most people don't really care about that.

Actually my account is also banned, and it took them 2 days between console and account ban. So people who only have their consoles banned and still playing around with Layerdfs etc are not out of the woods yet.

Of course they can ban you. If you are stealing content from their servers they can absolutely just remove your access permanently and close your account. Even in the EU, you're straight up breaking the law and that has consequences, and they will have a paper trail that would make any challenge impossible.

If people abuse the leniency on the account and download systems, they'll simply take it all away.
