I run CFW on SysNand and I havent been banned. I dont run cheats, I dont pirate games, and neither do I run all homebrew apps. I only just use EdiZon to backup/restore save data and I've been doing it for well over a year. I'm 100% connected to the internet
Nintendo haven't been actively banning people for like 2 years now. You might be fine, or you might be flagged, it's hard to say.

This came from atmosphere devs (ReSwitched Team) themselves:

Ban Risk:

Instant ban:
• Piracy of any sort
• Homebrew nsps
• Changing user icon through homebrew
• Sketchy eShop behavior

Not so instant ban, but still a ban:
• Modding online games
• Cheating in online games
• Clearing error logs after they've been uploaded to Nintendo (this may extend to using both emummc and sysmmc online, due to mismatched logs)

Not a ban, so far:
• Atmosphere itself
• Homebrew
• Custom themes
• Custom sysmodules (sys-ftpd-light, etc.)
• Mods/cheating in offline games
• Overclocking with sys-clk (just don't do it competitively, for all of our sakes)
• emummc

We just don't know enough yet:
• Screwing with PRODINFO, but NOT committing bannable offenses
• Using the experimental PRODINFO dummying included in Atmosphere 0.11.2 and later.

There's no 100% ban proof method, some can get away with it for sometime but we are never sure that they will never be banned. Tho you are 100% sure to be banned if you use installed NSPs that you do not own online. Heard some people saying that just using some homebrews won't trigger bans, like save restoring and stuff, but even then they do ban sometimes (in some games, it seems that they do it for Splatoon and Animal Crossing for example)
So no, there's no 100% ban proof method, just use incognito/90DNS if you still want to use your Internet connection but even then you are just reducing the odds of getting banned, not eliminating them.
Can't speak for Animal Crossing, but in regards to Splatoon 2, I restored a save I still use to this day about a year or two ago and I haven't been banned on said console. I suppose it's possible something was modified added after I've done this, however.

Not a chance. Running Atmosphere and SXOS alone does not trigger a flag. Everyone is afraid since others who were banned just say they ran CFW and got banned which is not 100% true. They did something to trigger a flag which caused them to get banned. No one likes to admit that they pirated games. They just like to blame CFW that caused the ban

That seems to be the case for Atmosphere but could change at any time, TX have a habit of messing up when copying Atmosphere so I dunno about SX OS. He has not just been running Atmosphere though. Backing up save data is probably fine but restoring save backups is messing with NAND files and that is where IMO you go from almost zero risk to potentially detectable especially if the game has online functionality as the servers could detect a modified or rolled back save.

I am using both SX OS online. no issue for now .

How I do ?
No save edit, no any nsp install.
No any emu nand or things like that.
Two accounts.
One Account I run any homebrew side from it, including the "channel" itself.
The other one I only play my legit game (online etc)
And sure I go online only with legit game, I mainly use Diablo, Overwatch and Mario Maker online.
When I use homebrew, XCI (SX OS) I put my switch on airplane mode to do so.
Each nintendo switch update I update it the legit way with the setting app, I do not care that much about fuse as most of my game (if not all?) can be played without CFW.

But I do not recommend it, you wanna play online just disable the CFW and play your legit game online, no idea if CFW leave traces of it's use.
And since I am not a pro in it I can not tell if that legit way to do things or not.

i watched your channel but you have a lot of videos haha... do you have a link to a video where you show how to get online with atmosphere? thanks

I've been playing ACNH and recently Mario Party Superstars online with atmosphere for over a year.

I use to use blank prod but I got tired of needing my dongle after rebooting to stock to play anything online.

I mostly use RetroArch but have used cheats and modified my ACNH save multiple times months ago. I've never used cheats while on other islands and don't have online saves enabled.

Am I flagged? No idea but I've been trucking along for a while. I decided I would use it as my excuse to buy an OLED but that hasn't happened yet. I also do everything on my main user with an active NSO account linked.

I read this thread long ago to see what others were experiencing. I accepted the potential risk based on my activity and just did it. Hopefully this makes someone else a little more comfortable with CFW online. It seems like everything is okay if you're a "good boy"

Bottom line, you should always be prepared for a ban before you try this but if you're already using CFW occasionally on your sysnand then you should be okay.

So the one thing I keep reading is "pirated nsp". Is that strictly pirated games or does that include any xci/nsp made from your own backup? I'm still relatively new to the Switch scene since downloading yuzu, so forgive me if this is rehashed.

This is what I am trying to acheive:

- I want to play online fully, not just LAN play, with my legit Nintendo ID.
- I want to backup my physical game cartridges onto one large SD card so I stop losing cartridges from my overstuffed game case
- I wouldn't mind emulation and homebrew, but it's not necessary.
- maybe a system overclock to help Age of Calamity run better, but once again not necessary.
- I will not be making any other modifications to save files or modding games.

Would this at all be possible without risking being banned? What would be the safest way to do this?
