Judge denies Nintendo's request to dismiss Joy-Con drift lawsuit, case heads to arbitration

The Joy-Con controversy continues. New information is out regarding the class-action lawsuit, filed back in 2019 over players having to deal with their Switch Joy-Con analogue sticks defectively drifting. Nintendo recently tried to have the case dismissed, but the presiding United States District Judge rejected the attempt. While the lawsuit won't be disregarded, it instead will be headed to arbitration, despite the wishes of the plaintiff, who believed that arbitration wouldn't allow affected users to get injunctive relief, likely meaning Nintendo wouldn't be required to fix Joy-Con drift. The case moving to arbitration requires both the plaintiff (Ryan Diaz) and Nintendo to come to an agreement together, with the help of an impartial third party.

Why not Microsoft? EVERY 360 controller I've ever owned had horrendous left analog stick drift. Some even when brand new out of the box. Literally EVERY one. Have never had an issue with a single PS1, PS2, PS3, or PS4 controller.

The Switch Lite has worse Joycon driff issues that the big Switch, so I am glad this lawsuit wasn't dismissed.

Lol this would just end up on Nintendo not having to fix anything for free after all. That's what arbitrary actually means in court against big companies, and likely setting up precedence on future cases.

That guy just fucked up all of the other customers.

Damn. You must have really bad luck when it comes to 360 controllers. Mine have literally not broken and i've use them for quite a while.

I don´t know the details but I assume Nintendo was not willing to deliver repairs or new Joycons. Suing is the final step.
I have heard that certain European countries have issues with these, but not the entire US, of course within the limits of the warranty.

They had been getting free fixes and new joycons like usual, even before the lawsuits, so that's just bullshit.

And this is why I hate corporations. They do such anti consumer moves but they always get away with it because they're the only option. Because there controllers cost almost 100 dollars and have shown signs of drifting within days of playing handheld especially zelda and game that requires constant thumb movement on the joycon will cause drifting.. i have 3 sets all do the same drifting gave i and bought another 100 controller switch pro controller.. yes smaller joysticks can drift easier but not necessarly true for all joysticks.. i have 2 ps vitas that get played alot not one has a drift problem... nintendo is all about profit they knew and didnt care they figured becauae there detachable consumers wont mind but when these things cost as much as they do and fail at the rate th3y do nintendo should be held accountable.
Not even 100 dollars. My $20 logitech f310 never once drifted. The Switch joycon analogs are just plain crap.

I say it's the only option because sony microsoft and nintendo are the main 3 hardware publishers in the gaming scene- no one else. if i were to try to make a new console i'd fail immediately since those 3 already have an unstoppable monopoly

Ahh, yes. At least something's happening. I was lucky enough only to lose one set of joy-cons to drift, and Nintendo fixed them up for free, after I sent them in. However it'd be easiest if I just.. didn't have to send them in at all.

Out of all the joycons out ther thers prob less than 1% thts faulty or just aggressive use by the player and I don't want to see Microsoft at the top of the tree at console gaming as they should stick to pcs due to as you prob kno the xbox one name was total BS and the Series X with another x in the title is mor BS lol
I bet that percentage is above 40℅

Overall, I don't like how they are handling this Joy-Con thing. I didn't even know they were changing them. That said, at least they are replacing them and are trying to fix them, but I feel like they need a better design altogether.

The margins on consoles are already razor thin (see any number of bill of materials breakdowns). They could do some kind of loss leader and offset that with game licensing but eh, not to mention it would be rather hard to enforce that.

Anyway as for the hypothetical of bringing manufacturing jobs to the US... between environmental regs, cost of land, taxes and whatever else that would mean about 5 highly trained engineers (several possibly not even in the state) and their managers, with a couple of people shovelling things onto lorries, running a massive automated factory.
The lines of semi skilled peeps in white suits like you see on all the videos are only that way because things are, or actually were (as mentioned things are moving out of China, mainly to other places that have not yet had decades of billions being pumped into them yet), that cheap that they could do that instead of spunking a few billion making a robot to do it and come out ahead by the end of the run. Said billions are dropping all the time though (the cheapo 3d printers and CNC machines you are all enjoying having in your garage also has implications right to the top, along with existing libraries of designs of things to do it -- soldering and chip placement is just that and has not changed too much).

None of that would alter what looks like poor materials selection, flawed design and lack* of testing that led to this.

*I presume it is a lack rather than someone fluffing a number in the total cost of replacement vs cost of lawsuit calculation.

Ive never seen a brand new switch have this problem

I always see this on nasty switches brought in - Mostly from kids

Wear and tear and mishandling of the hardware is the cause

Nin should not have to be dealing with this

sorry you‘re just dumb, I take care of my switch and the joycons drift nonetheless. I don’t even play that often.

Nintendo of Europe won‘t even repair them for free out of warranty.

So you broke your sticks and mad Nintendo wont replace your sticks because they are out of warranty. Classic dirt bag. They broke themselves I guess. You my friend are the dumb one...Not sorry.
