Can't Nintendo just ban by battery serial?

Sure you can change batteries but it would be inconvenient to get a new battery Everytime your banned.

Incognito is great for blocking the console serial but it may be more useful if it blocked all serials.

Wondering what people think

They could, but they won't. There's too high of a chance of someone harvesting a battery to replace their failed one.

Nintendo could probably figure out the serial number of the console with 99% accuracy just by looking at the joy-con serials and battery serials, but they don't want to accidentally ban legit consoles on that 1% chance.

Why would they use a battery, which can be replaced, when there are nice internal serials that are baked into silicon?

This also assumes you can read the serial from a battery. There are enough pins there and even with the parallel wires (power and ground both have two, presumably to avoid the issues with having one fat bit of wire each) but I don't know if it is capable of it as much as just temp reading or something.
That said I have not kept up there and serials have been read from batteries for years on many other things when the manufacturers wanted it.

Honestly it's a dumb idea
Also because the fact its read externally not internally it will be easy to spoof.

Also It would be hard to counter 3rd party batteries or random consoles getting banned because of it

Incognito 2.0 lets you change the battery serial.

is it stored separatedly on sx emunand and stock sysnand?

New tinfoil has an ssl disable option? is it an extra layer of protection?

There are also tons of new options, like Mac address, region code .... Do all of those get changed separately on emunand and sysnand?
