ROM Hack Question So is it possible to play backups of my games online?

Hello, so I haven't been into hacking/backups since the Wii.

From my understanding of how the switch works from looking through this website, each game has a unique identifier code that gets sent to Nintendo for verification.
Is this correct?

So my question is, if I have a game, make a backup of same game, can I legitimately play the backup online without a ban?
What happens then if I decide to sell the game?

If I am in the wrong sub forum, please redirect me to the right one.

No you cannot play online with a backup. You have to be on CFW to play a backup, Nintendo can see when you're online on CFW. You could be banned at any time. You might make it a while but you will be eventually flagged for a banned.

Eventhough you own a game a back up is still pretty much pirated software in nintendo eyes and highly likely you will get ban once detected.

There are a few people that claim to use XCI backups of games they legitimately own and play online without getting banned, with SX OS.

That being said, it's probably not worth the risk, especially for games that you own anyway. Is a ban risk worth the convenience of not carrying the cartridges with you?

If you sell or give the game to a friend, and they happen to be playing it at the same time as you are, Nintendo will very likely ban you both.

And playing any pirated game online, whether NSP or XCI, is a surefire way to get banned. Even without playing them online, you might get banned just for going online while pirated NSPs are installed.

Basically, if it's a XCI backup made by yourself from a cartridge you own, and you neither gave a copy of the file to anyone else nor allowed anyone else to use your cartridge while you use the backup, it's theoretically possible to play online using SXOS and not get banned. It's not guaranteed, though; better to just use the cartridge to play online (preferably from OFW while only using CFW with an EMUNand).

If you go online with a non-tampered "backup" that you don't have full control over, and anyone in the whole planet decides to go online with either the same backup or the original cartridge that backup was made from, then Big N can instantly detect it and ban everyone involved.

If it's a tampered file — be it a XCI with a changed or otherwise tampered header, a NSP not installed through the official store, a XCI installed as a NSP, whatever — then Big N can also instantly detect it and ban you.

Ah ok, definitely not worth it then. Not being able to go online is a dealbreaker with some games i.e Mario Kart or Pokemon battles.

Only if they are XCI dumps. A NSP will obviously be a dead giveaway since they can tell you don't own the game on eShop.
But only SX OS runs XCIs, and SX OS itself is known to be detectable by Nintendo. They still haven't implemented creport I believe, so logs will be sent to Nintendo.

Latest version has implemented creport. They stole it from Atmosphere. They even had to release an update because they accidentally left in references to the atmosphere folder.
