Obviously I have a switch which is unpatched and I would like to use it for homebrew only ( no piracy ). With that being said, is it still possible to get banned ? If so, why ?

Yes nintendo doesn't care whether you use it for homebrew only or piracy. Once you start hacking your switch it's already a bannable offense to them.

Depends. If you install anything, by all means yes. If only homebrew? No not so high of a risk. BUT the risk is ALWAYS present.

well, sony lumps both piracy and just using homebrew together with: "unauthorized or pirated software." that's to get everything. even if sony, or in this case, nintendo thinks everyone using homebrew is also pirating they can't really prove it.

Well, that's not far off from reality, is it?
Take away "backups" and emulators, how many Homebrew users would be left?

Sony doesn't seem as rigid with its banhammer -- at least on the vita.

There is always a small risk, but generally homebrew doesn't modify the system, and Atmo redirects log writes, so in theory, it should not be detected, though Nintendo could at any moment add code to detect kernel patches or homebrew in a firmware update. It is always best to stick with an offline or Incognito ( https://gbatemp.net/threads/incognito_rcm-wipe-personal-information-to-reduce-risk-of-ban.549462/ ) patched emuNAND for all your CFW and homebrew needs and keep your sysNAND 100% clean. That way there is just about zero risk (there is a very small chance they could detect the emuNAND partition or files on the SD but that's easily avoidable by using two SD cards)

if you can afford it, buy a separate switch and keep one hacked and never go online and have the other switch to keep legit.

Yeah but for the moment this old switch i have right now will be the hacked one. the separate switch will be my vanilla one. thanks for the info.

Unlikely. If you only use homebrew, no piracy and cheating shit, you likely won’t get banned.

I definitely wouldn't risk it. Nintendo doesn't care what you do with a hacked out system, they straight up don't want you hacking your system at all, so if they can detect it's been hacked, I wouldn't be surprised if they'd ban it.

I just go online normally as I normally would :P. I’ve been doing this for a year an a half now and haven’t been banned. All I do in my emummc (which is what I use for normal use currently, my sysmmc is used for some spicy memes) is use themes and run homebrew, no piracy or any of that junk.
