Hacking If the risk is so high is it really worth it for me?

So I had a look around but couldn't really see anything too relevant to help me so hopefully you'll be able to clear this up for me.

Firstly I'm alright with the homebrew scene, iv done a few devices already

All I want to jailbreak the switch for is ps1 games and a retro engine from what iv seen/read retroarch plays ps1 quite easily on jailbroken switches.

If I jailbreak the switch and have retroarch for example on there, then go online with my paid for games from the Nintendo store can they track that and check if I have 3rd party software on the switch when not using it? or is it as simple as when using retroarch for example making sure that I'm offline?

Also I'm pretty sure I'm right in saying when we talk about goin online with games on a homebrew switch were talking about being online and opening the game software and not 'playing online' as I have no desire to ever purchase the Nintendo online pass thing....

I doubt I'd ever really be pirating any switch software due to most of the attractive titles being ports/remakes and I do still have a homebrew vita which has retroarch will all the games I'd want/need on there, just much prefer the improved screen on the switch

As I'm sure you can tell I'm not too technical when it comes to all this just looking for some extra info help me decide if it's worth it!

hacked vita can do your retro needs now ur against piracy of course but what are your thoughts on backup games you already own for backup purpose and remove the need to carrying the physical cartridges. so if u like collecting physical games you may want to do this.

backup games you own is actually legal as long as you don't distribute them. plus the remakes will be on the switch and not vita

you can setup a emuand which is store on sd card which you leave for cfw stuff and sysnand for online which there are some games that are digital-only and since its region, free u can access the Japanese eshop for Japanese only games

If all you’re gonna do is play ps1 games, then you can install Lakka on the switch.
There is pretty much no risk for getting banned and it’s simple to install.

There is pretty much no risk for getting banned and it’s simple to install.

No ban risk exists on Lakka, it's a ARM64 Linux distribution that work out of the original Nintendo Firmware (HorizonOS), so are impossible that you get banned for run it.
