Hacking Question Doubt about my SD and CFW Sysnand. Will I be banned?

I have a sysnand which should be clean, and my emuMMC which is 'dirty' but never went online, it has BEFORE using it no WI-FI networks, and is in airplane mode. It has been like this since it was copied from my sysnand, which is actually like this, but it has been online before.

So, knowing that my sysnand went online before, but never after making the emuMMC nor installing NSPs on the emuMMC, AND nor the emuMMC did, I went to sysnand with the CFW option on Hekate but did anything but stay on the home menu, and went to the gallery to use hombrew menu to reboot to hekate. No NSPs installed, nor installs, nor anything dirty while in CFW sysNand, so, if I want to go online now on my sysnand, what should I do? Do as usual? Or since I went to CFW sysNand and used the gallery to use homebrew menu, I will probably be banned? If no, then there is a second question.

Should I take my SD out of my SWITCH before going online or should I do anything special so I don't get flagged?

Edit: I should have said that I went to sysnand (both CFW sysnand and non-CFW sysnand) through HEKATE, so that maybe changes the answers.

Now I can't give a definitive a answer on that mate. with that being said though, since you didn't run any NSPs and stuff like that it poses a minimal chance of getting a ban nonetheless.
Likewise I don't know whether Nintendo will ban you for simply having homebrew files on your SD card, regardless of whether you will boot them or not.
My guess would be to boot stock sysnand and use another SD card with it to avoid traces of homebrew data on that SD card.
Now you said that this current emuNAND of yours derives from your sysnand having the same data right?
In that case NEVER connect or attempt to connect it online then.
By doing so you could banhammered on both NANDs.

Use all hacks with your dirty NAND.
Only go online with your clean NAND.
If you're paranoid, install 90DNS and/or Incognito to your dirty NAND.

Following these instructions will make it highly unlikely that you will be banned.

ReSwitched Discord claims there is no way you could get banned simply for running Atmosphere and not doing anything else (running homebrew is fine too apparently), not sure if running it through Hekate or fusee-primary makes any difference to that.

I made the test this morning just because if I was banned, I'd been banned even if I didn't do anything, so in the end, I didn't have anything to lose. It resulted that I wasn't banned, at least not from downlading the updates from the system update and downloading from the eShop. I am not sure about online play, since I don't have Nintendo Online bought, nor I will for a while.

So basically, I haven't been banned. If I will be, I'm not sure how long I will not be banned.

Oh, and what I meant is that my emuMMC was a copy of a clean sysnand. Formatted before the emuMMC so all accounts are unlinked, and no Wifi + plane mode was enabled. I didn't do anything dirty to that sysnand before making the emuMMC. The emuMMC is, and will be, the only place dirty things will happen. Without any wifi configured and always in plane mode.

Yeah, the thing was about if I could get banned on my sysnand for just running CFW Sysnand from Nyx. I mean, if by doing that, and only that, on my sysnand, could I have been flagged. And if Nintendo could check my SD on sysNand and ban me foor what I have in it.

That's what I do, and will do. My sysnand is completely clean (without counting that time I went to CFW sysNand, in which case, I just turned the console off after booting it), and my emuMMC, doesn't have any type of connectivity outside the SD. So, I couldn't get banned because of the dirty things on my emuMMC, unless Nintendo is capable of checking my SD to see any traces of these things, which is what made me worry.

That's what I thought and what I thought I knew. But I couldn't find an appropiate answer to my questions, so... Anyways, thank you for the information!

Thank you everybody for your help, the results are that I didn't get banned (as for now) just because I went to my sysnand using CFW, and apparently, nor my dirty SD was a problem too.
