No, you won't get banned, i have a banned Switch, as well as a clean Switch, i just signed in on my new Switch with my old account, it had the NSP games that i had installed in the hours played (lol) and yet to date, im playing Smash Bros Online with my new Switch and my old account.

Same ban dude, it's just a console ban, NSP install and offline play was the reason, your account is totally clean, just unlink it from the Nintendo website as soon as you can and link it to your new switch
Did you also used edizion or something like that for save games tho? I did it but not for any game i play online

I have heard from people who have called Nintendo about their ban and asked if they could buy a new console and use the account on it and the rep said that that would be fine, and a bunch of people have done this exact thing with no reports of bans on the new consoles. As long as you're buying games and not hacking the new console they are making money and it would be in their own best interest not to ban you again unless you give them a reason to.
You can't do a system transfer if one console is banned. You can however use the new Switch as a secondary Switch or call them and have them unlink it, the latter would be best so you don't have to be online to play any of your eShop games or DLC. If you didn't have Nintendo Switch Online with cloud saving enabled then there's no legitimate way to transfer your saves across. And even cloud saves don't work for every game. But you can keep playing whatever single player games you have on the banned console, you'll just have to start fresh in any game you want to use online functionality in.
Im mostly concerned for splatoon 2, and crash team racing nitro fueled.

No cloud saves for Splatoon 2, I'm afraid. If you're lucky some of the data (like your level/ranking) might be tied to your Nintendo Account.
Doesn't really matter, if you go online on the same NAND you use for CFW stuff getting flagged is highly likely and then it's just a matter of time before you get banned. That's part of the reason why emuNAND exists.

Nintnedo can't Ban your Account,bcs of the worth it has (on). If you get hardbanned,you have 5 options for your account.

Risky, considering each game will have a unique cert. if you connect to online and update and the Nintendo servers see 3000 copies of smash bros as EG with the same cert. genuinely surprised you haven’t been banned yet
