Hey guys so I finally decided to get a CFW running on my switch (atomosphere 0.9.1) and I've gone through all the safety precautions with DNS etc. Now I don't have a console ban at this moment in time but if I were to boot into the switch without CFW turn DNS to auto and update my legit Eshop games through the home screen would this give me a online ban or is it safe to do so?

If this would ban me how would I go on about updating my legit titles ?

Thanks for your help !

You can do it, but after several tries you will get a ban.
You should update your legit games offline, like they were not legit!

Going online to update games while running CFW will highly likely flag you for ban, even if those games were bought legit. We don't really know at this time what info does Nintendo collects and they might be able to figure out if you are runnning CFW.

That been said, from CFW you can use goldleaf to install the latests game update nsp for the game you need to update.

As a rule of thumb, if you don't want to have your switch banned, stay offline.

You should always avoid connecting online if you don't want to get banned, as there is always a risk.

Personally I do update my games via OFW Nintendo servers, but I'm using SX OS XCI only.. (Never installed NSP)
I was also testing CCProxy and blocked all the servers, except for certain ones so that I can update firmware/games and download free DLCs from eshop.

So in conclusion, there must be some type of information Nintendo obtains that flags the ban.. (my speculation is the cert of the NSP?) From my understanding (correct me If I'm wrong), XCI certs are pretty much generic and identical on all carts.
